Complex criminal cases

Lawyer for complex cases: tax evasion, embezzlement, abuse of office, human trafficking

Cases involving economic crime, offences committed in office or organised crime run to thousands of pages, accounting expert reports and asset freezes. We provide a careful defence built on a full study of the file and an understanding of the financial documents.

Complex cases and economic crime

A complex case differs not only in the seriousness of the charge but also in the volume and nature of the evidence: accounting and tax records, inspection reports, expert reports, intercepted communications, bank data and letters rogatory to other states. In such cases the defence is won or lost in the details, and every investigative act must be checked rigorously.

We assist clients in cases handled by prosecutors' offices, the National Anticorruption Directorate (DNA) and the Directorate for Investigating Organised Crime and Terrorism (DIICOT), from the investigation stage to trial and appeals. We study the entire file, analyse the evidence and expert reports, propose defence evidence and challenge unlawful or disproportionate preventive measures and asset freezes.

The lawyer's background in economics, as an insolvency practitioner, helps in practice in tax evasion, embezzlement or money laundering cases, where understanding balance sheets, financial flows and forensic accounting reports is essential. We represent individuals and companies under criminal investigation, as well as injured parties seeking to recover their losses.

FAQ

Frequently asked questions

What is a complex criminal case?

It is a case with voluminous and technical evidence: accounting records, expert reports, interceptions, several defendants or acts committed in several states. Such cases are usually handled by DNA, DIICOT or the prosecutors attached to county courts and take longer than ordinary cases.

What can I do if my assets have been frozen?

Precautionary measures ordered in criminal proceedings can be challenged within the time limit set by the Code of Criminal Procedure. Grounds may include, for example, disproportion to the alleged loss or the fact that the assets belong to someone else. The challenge must be filed quickly and well reasoned.

Does paying back the loss help in a tax evasion case?

Under certain conditions provided by law, full repayment of the loss may lead to reduced sentencing limits. The conditions and the deadline for payment are strict, so the decision should only be made after a specific analysis of the file.

Can you take over a case already before the court?

Yes. We can take over the defence at any stage: investigation, preliminary chamber, first-instance trial or appeal. The first step is to study the file to see which requests and evidence can still be submitted.
